BY ACCESSING OR USING THE SITE, YOU ARE ACCEPTING THESE TERMS OF USE (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT) AND YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ENTER INTO THESE TERMS OF USE (ON BEHALF OF YOURSELF OR THE ENTITY THAT YOU REPRESENT). IF YOU DO NOT AGREE WITH ALL OF THE PROVISIONS OF THESE TERMS OF USE, DO NOT ACCESS OR USE THE SITE.
By accessing or using our site or downloading our STL files, you agree to the terms below; if you do not agree, do not use the site.
PHYSICAL PRODUCTS NOTICE:
All Terrain is sold for personal use only; you may not recast, reproduce, or mass-produce any physical items purchased from Lunes d’Argent Workshop. Furthermore, while the Customer (Dungeon Master) holds ultimate authority over the use of our Arcanestone Terrain within their game world, Lunes d’Argent Workshop is not liable for any Total Party Kills (TPKs), character deaths, or emotional damage resulting from the use of these items.
Personal Use: You can print these files for your own personal use, but you may not sell the printed items or distribute the digital 3D models except if you have a commercial license with us.
Commercial Licensing: Commercial license holders are permitted to sell their prints for the duration of their contract.
1• License. Subject to these Terms of Use, Lunes d’Argent Workshop grants you a non-transferable, non-exclusive license to use the site and STL Files for your personal, non-commercial use.
2• Restrictions. The rights granted to you in these Terms of Use are subject to the following restrictions: (a) you shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the site, Services, or materials you print under this license; (b) you shall not modify, make derivative works of, disassemble, reverse-compile, or reverse-engineer any part of the site or STL Files; (c) you shall not access the site or Services or STL files in order to build a similar or competitive service; and (d) except as expressly stated herein, no part of the site or Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means.
3• Modifications. Lunes d’Argent Workshop reserves the right, at any time, to modify, suspend, or discontinue the site or Services or any part thereof with or without notice. You agree that Lunes d’Argent Workshop will not be liable to you or to any third party for any modification, suspension, or discontinuance of the site or Services or any part thereof, except and if otherwise expressly set forth in Section 8.
Any future release, update, or other addition to functionality of the site or Services shall be subject to the terms of these Terms of Use. All copyright and other proprietary notices on any site or Services content must be retained on all copies thereof.
Lunes d’Argent Workshop reserves the right to change these terms and conditions at any time.
4• No Support, Maintenance, & Refund Policy. (a) You acknowledge and agree that Lunes d’Argent Workshop will have no obligation to provide you with any support or maintenance in connection with the site, services, or STL files. (b) Digital Files: All 3D files are non-refundable once downloaded by the user. (c) Physical Products: Due to the handmade nature of our inventory (hand-painted, made-to-order items), orders for physical products are non-refundable once production has commenced or the item has shipped.
5• Ownership. Excluding your User Content (defined below), you acknowledge that all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets, including STL files on the site, are owned by Lunes d’Argent Workshop or Lunes d’Argent Workshop’s licensors. The provision of the site and STL files does not transfer to you or any third party any rights, title, or interest in or to such intellectual property rights. Lunes d’Argent Workshop and its suppliers reserve all rights not granted in these Terms of Use.
6• Communication and Privacy. We may collect and process data about you, including data provided by you by filling in forms on our site, and details as a result of your visits to our site. By using our site, you expressly consent to us collecting that information.
We will use your data to: a) process any purchases made by you; b) ensure that content from our site is presented in the most effective manner for you and for your computer; c) provide you with information, products, or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes; d) allow you to participate in interactive features of our service, when you choose to do so; and e) permit selected third parties to use your data to provide you with information about goods and services which may be of interest to you, and you agree that we or they may contact you about these from time to time.
You agree that by setting up an account to buy from Lunes d’Argent Workshop, you give Lunes d’Argent Workshop permission to send emails to you, including marketing and information emails. You can unsubscribe from such emails at any time.
